Online Store Terms and Conditions

The owner of the online store (https://koduuhkus.ee/) (hereinafter referred to as the “Online Store”) is OÜ Kodu Uhkus (registry code 12401135), located at Pärnu mnt 129c/1-43, Kesklinna district, 11314 Tallinn, Harju County.

Validity of the Sales Contract, Product and Price Information

These sales terms apply when purchasing products from the Online Store.

The prices of products sold in the Online Store are listed next to the products. An additional fee for delivery will be added to the price. All prices in the Online Store are listed in euros.

The delivery fee for products depends on the buyer’s location and the method of delivery. The delivery fee will be displayed to the buyer when placing the order.

Product information is provided directly next to the product in the Online Store.

Placing an Order

To order a product, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in, and the appropriate delivery method must be selected. The total cost, including the delivery fee, will be displayed on the screen, and the payment can be made securely via the following payment methods:

– Invoice payment – after confirming the order, an invoice will be sent to your email, along with the necessary payment details.

The contract will be valid once the payment amount is received in the Online Store’s account.

If the ordered product cannot be delivered due to stock depletion or any other reason, the buyer will be notified as soon as possible, and any paid amounts (including delivery fees) will be refunded immediately, but no later than 14 days from the notification.

Delivery

Products will be sent to the following countries: Estonia

To receive the product, the buyer has the following options: Omniva Parcel Terminals across Estonia.

The shipping costs are covered by the buyer, and relevant pricing information will be displayed with the shipping method.

Domestic shipments in Estonia typically reach the buyer’s designated location within 14 working days from the conclusion of the sales contract.

In exceptional cases, the delivery may take up to 45 calendar days.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day return right, the product must not be used for any purpose other than to check its nature, characteristics, and functionality, in a way that would be allowed for testing the product in a physical store.

If the product has been used for purposes other than verifying its nature, characteristics, and functionality, or shows signs of usage or wear, the Online Store has the right to reduce the refund in accordance with the decrease in the product’s value.

To return a product, the buyer must send an email to info@koduuhkus.ee within 14 days of receiving the product. The email should include the order number and details of the product to be returned.

The cost of returning the product will be borne by the buyer unless the return is due to the product being incorrect or defective.

The buyer must return the product within 14 days following the submission of the withdrawal request or provide proof that the product has been handed over to the carrier within that period.

The Online Store will refund the buyer any amounts paid under the contract, including delivery charges, immediately upon receiving the returned product, but no later than 14 days after receiving the withdrawal notice.

The Online Store may refuse to make the refund until it has received the returned item or until the buyer has provided evidence that the item has been returned, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery offered by the Online Store, the Online Store is not required to refund the extra cost beyond the cost of the standard delivery.

The Online Store has the right to cancel the sales transaction and demand the return of the product if the product price in the Online Store has been significantly reduced due to an error, below the market price.

Right to File Complaints

The Online Store is responsible for any product defects that existed at the time of delivery and become apparent within two years of delivery. Within the first year of delivery, it is assumed that the defect existed at the time of delivery. The burden of proof to refute this assumption lies with the Online Store.

The buyer has the right to contact the Online Store about any defects within two months of discovering them by sending an email to info@koduuhkus.ee.

The Online Store is not responsible for defects that arise after the product has been delivered to the buyer.

If a product purchased from the Online Store is defective, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund the buyer any amounts paid under the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a form that allows for written reproduction within 15 days.

Direct Marketing and Personal Data Processing

The Online Store uses the personal data provided by the buyer only for processing the order and delivering the product to the buyer. The Online Store will transmit personal data to transport companies for the purpose of delivering the product.

The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed interest by entering their email address on the website and indicating their desire to receive marketing communications.

The buyer can opt out of receiving email offers and newsletters at any time by notifying the Online Store via email or following the instructions in the email containing the offers.

Dispute Resolution

If the buyer has complaints about the Online Store, they should send them to info@koduuhkus.ee.

If the buyer and the Online Store cannot resolve the dispute amicably, the buyer may submit the matter to the Consumer Disputes Committee. The terms of the procedure can be found, and a complaint can be filed here. The Consumer Disputes Committee has the jurisdiction to resolve disputes arising from the contract between the buyer and the Online Store. The review of the complaint by the Committee is free of charge.

The buyer may also contact the European Union’s platform for online dispute resolution.
